A Florida real estate agent who says she’s received “multiple” automated telemarketing calls from Zillow or a company working on its behalf on a cell phone number that’s on the National Do Not Call Registry has filed a lawsuit against Zillow seeking class-action status to represent “hundreds, if not thousands” of other Florida agents who might also have received unauthorized calls in the last four years.
In their complaint, attorneys for Coral Springs-based real estate sales associate Bonnie Metviner said that while her telephone number “may appear in certain publicly available materials, in relation to certain properties or offerings,” she did not consent to being contacted by Zillow or its representatives.
The complaint seeks an injunction prohibiting Zillow or its agents from engaging in “unsolicited telemarketing in violation” of the Telephone Consumer Protection Act, and statutory damages.
Attorneys for Zillow have not yet filed a formal response to the complaint, filed Monday in federal court.
A Zillow spokeswoman said the company respects “the privacy of our customers and potential customers. We have developed policies and procedures designed to comply with consumer protection laws such as the Telephone Consumer Protection Act. We take this complaint very seriously but, as this is outstanding litigation, we are not able to comment at this time.”
